Fee Schedule

I am a Florida Probate Attorney who uses a reasonable Flat Fee Probate Fee Schedule for attorney’s fees.

Many estate attorneys in the state charge 3% of the first $1 million of the estate in probate fees, which is presumed reasonable under Florida law. That method can lead to gross overpayment of a probate attorney. I do NOT charge the statutory formula for probate fees. Below is my attorney fee schedule for Probate, well below the Florida Statute suggested fees. Filing fees and costs are additional.

Summary Administration: $800.00

Full Administration: $1500 plus 1.5% of the estate

Flat fees for Florida probate matters are often sufficient provided the case is uncontested and there is a manageable number of estate creditors to address. Keep in mind that even the “simplest” of cases require a measured amount of work. There is no single form or “small estate affidavit” for the majority of probate cases.
